Annual General Meeting of NAAU labor collective was conducted

On April 27, Annual General Meeting of NAAU labor collective was conducted in NAAU premises in order to consider issues regarding NAAU activity and fulfilment by NAAU administration the conditions of the collective agreement. 33 employees of NAAU were present.

During the meeting the following questions were considered:

1. Implementation of the terms of the Collective Agreement by Administration of NAAU.

Decision: Administration fulfills the conditions of the Collective Agreement of NAAU.

2. Amendments to the Collective Agreement for 2015-2017.

Decided: To amend the Collective Agreement for 2015-2017.

3. The feasibility of the transition to service payroll project to another bank.

Decided: Till 04/30/2015 each employee has to write a statement indicating the bank service.

4. Preparation and readiness for EA evaluation of NAAU.

Offer: Take note of information.

5. Regarding consideration of a letter dated 20.04.2015 № 1071 from the Ministry of Economic Development and Trade of Ukraine.

Proposal: To charge the representative of NAAU labor collectives, Kolomiets V.S. to prepare a letter of response to the Ministry concerning the situation in NAAU.

and Trade of Ukraine during general

meeting of NAAU labor collective

Having received a letter of the Ministry of Economic Development and Trade of Ukraine dated 16.04.2015 № 3242-07/12331-09 addressed to the labor collective of the National Accreditation Agency of Ukraine (hereinafter – NAAU), an authorized representative of the NAAU labor collective initiated a general meeting of the labor collective with the aim to consider issues regarding NAAU activity and implementation of terms of the collective agreement by administration.

The general meeting of NAAU labor collective was conducted on 27.04.2015.

The meeting was legally qualified, since more than half of the total number collective participated in it.

During the meeting issues raised in the letter of Mr. Pechinka and others were considered.

In particular, implementation by administration of terms of the collective agreement  regarding the structure and personnel changes, preparation for evaluation by the European Cooperation for Accreditation (hereinafter – EA), the competence of specialists and financial activities of NAAU.

During discussion of the above mentioned issues the administration informed the labor collective about the following.

Concerning the structure and staff changes in NAAU

As of 01.08.2013 there were 90 applications for works on initial accreditation, 109 applications for works on re-accreditation in NAAU on the stage of performance, and it was needed to conduct 266 works on surveillance for activity of conformity assessment bodies till the end of the year. It was planned to conduct 180 works on initial accreditation, 220 works on re-accreditation and 347 works on surveillance for activity of conformity assessment bodies in 2014.

In 2013 NAAU established close cooperation with the Ministry of health of Ukraine and the State Service of Ukraine on Medicinal Products in the sphere of accreditation of medical laboratories and bodies certifying medical products. Also it was planned to conduct training for personnel on accreditation in this sphere, including training abroad with the aim to start accreditation of medical laboratories and medical products certification bodies.

According to the Plan of preparation for assessment of the National Accreditation Agency of Ukraine approved by the Ministry of Economic Development and Trade of Ukraine, NAAU conducted all necessary actions and performed all tasks prescribed by the Plan.

Basing on the results of peer evaluation conducted from 12.05.2014 till 16.05.2014, European Cooperation for Accreditation made a decision regarding confirmation of NAAU recognition in the scopes of:

- personnel certification bodies according to the standard ISO/IEC 17024,

- management systems certification bodies according to the standard ISO/IEC 17021,

- calibration and testing laboratories according to the standard ISO/IEC 17025,

and also regarding the enlargement of recognition in the scope:

- inspection bodies according to the standard ISO/IEC 17020.

Furthermore, a positive decision was made regarding recognition of NAAU in the scope of accreditation of products certification bodies according to the standard EN 45011/ISO/IEC 17065 with the special conditions – conducting surveillance for all products certification bodies and analysis of NAAU work with CABs located in the area of antiterrorist operation in Donetsk and Lugansk regions, as well as on the territory of AR Krimea.

Taking into consideration the amount of accreditation activities and the need to ensure their timely implementation, qualitative selection of personnel on accreditation, organization of keeping the Register of accreditation certificates and implementation of conformity assessment bodies accreditation in the medical field, increasing requirement for qualification of executors of accreditation activities, successful conducting of EA evaluation, the need for making changes in the structure and manning table of NAAU.

Moreover, according to the requirements of current legislation, for the porpuse of effective and qualitative performance of accreditation activities, appropriate performance of tasks, NAAU by the letter dated 08.08.2013 № 1-4/6-1115 sent for approval of the Ministry of economic development and trade of Ukraine the project of a new organizational structure and manning table with the increased number of NAAU staff units from 63 to 86 (Annex 1).

Having considered received documents the Ministry of economic development and trade of Ukraine on 24.10.2013 approved the manning table and organizational structure of NAAU, which was sent by the letter dated 24.10.2013 № 2103-11/37098-07 (Annex 2).

It should be admitted that during the EA evaluation of NAAU, according to the requirements of the international standard ISO/IEC 17011 «Conformity assessment – General requirements for accreditation bodies accreditіng conformity assessment bodies» the objects of evaluation were the following:

- the structure of the national accreditation body (including issues regarding independence, impartiality, financial stability and confidentiality);

- general management (management system including the control of documents and records, competence of a person responsible for quality, internal audit, corrective and preventive actions for nonconformities and potential nonconformities, management review, complaints etc.);

- human resources (availability of sufficient number and neccessarycompetence, regular performance of monitoring, keeping files of accreditation personnel) both for internal and external personnel of NAAU;

- accreditation processes (initial, re-accreditation, planned unplanned assessments, works on enlargement and reducing of accreditation scopes, etc.), including all stages in accordance with chapter 7 of the above mentioned standard;

- responsibilities of accredited conformity assessment bodies and NAAU.

Basing on the results of the evaluation, including assessment of structure and human resources, there were no remarks.

Taking into consideration economical situation happened in Ukraine, annexing of the territory of AR Crimea and conducting antiterrorist operations in Donetsk and Lugansk regions, NAAU will not be able to perform in 2015 works on accreditation of accredited CABs located in the above mentioned areas, namely:

Donetsk region – 49;

Lugansk region – 23;

AR Crimea – 30.

Besides, number of other factors also influence on the reduction of amount of accreditation works. For example, after approving the Resolution of the Cabinet of Ministers of Ukraine dated 10.09.2014 «On optimization of the central executive power bodies», measures are conducted for liquidation of the State inspection of agriculture and its territory bodies containing 8 accredited laboratories, which in turn leads to the exclusion of these laboratories from the NAAU work plan for 2015.

Furthermore, after suspension of accreditation certificates by the application of CABs (due to the difficult financial situation) 50 bodies were excluded from the NAAU work plan for 2015.

It also should be noted that there was a tendency in the end of 2014 for reducing the work of monitoring approximately 30% of the planned. One of the main factors of reduction of works amount is receiving by NAAU letters from CABs with the request to postpone the planned surveillances due to difficult financial situation. Thus, during 2014 NAAU received 115 letters from CABs.

On the basis of the above mentioned and having conducted the full analysis of all types of accreditation activities, it has been concluded that there will be reduction of works amount in 2015 comparing to the previous year.

Taking into account the above mentioned, NAAU management made a decision on making changes in the manning table, namely reduction of 34,5 staff units.

The general number of NAAU staff will be 51,5 units.

It also should be noted that NAAU in accordance with the requirements of current legislation, by the letter dated 17.12.2014 №1-4/4-3738 sent for approval of the Ministry of economic development and trade of Ukraine the organizational structure and manning table.

After consideration of the documents received, the Ministry of economic development and trade of Ukraine on 29.12.2014 approved the manning table and organizational structure of NAAU, which they sent by the letter dated 15.01.2015 № 3252-16/723-08.

During reducing the number of staff workers due to the changes in organizational structure and manning table, NAAU strictly complies with the provisions of the labor legislation.

In particular, provisions of the article 184 of the Labour Code are taken into account, where it is prohibited to dismiss pregnant woman and woman who has children younger than three years (under six years – the sixth part of the article 179 of the Labour Code), single mothers if they have a child under the age of fourteen or a disabled child.

Meanwhile, when take a decision on dismissal of employees, NAAU is guided by norms of the article 42 of the Labour Code «Preferential right to remain at work when dismiss employees due to the changes in organization of production and work».

NAAU in accordance with the article 492 of the Labour Code has warned all workers about a possible future dismissal upon the completion of 2 months from the date of warning and proposed work.

Furthermore, according to the requirements of the clause 6.1 of the international standard ISO/IEC 17011 an accreditation body shall have sufficient number of competent personnel (both internal and external personnel).

In case of involving external staff, an accreditation body shall take measures (including to conclude agreements) which determine rights and responsibilities of such personnel.

According to the modern experience of national accreditation bodies (NABs) of European countries, personnel on accreditation can be both internal and external staff of a NAB.

Thus, meeting the provisions of the article 6 of the Law of Ukraine «On accreditation of conformity assessment bodies», taking into account provisions of the standard ISO/IEC 17011 and international experience, NAAU as a national accreditation body keeps the Register of personnel on accreditation and concludes appropriate agreements with external accreditation personnel.

In any case, such accreditation personnel shall meet the requirements determined for accreditation personnel regardless of whether they are internal or freelance staff. Usually, such requirements include requirements regarding experience of participation in assessments of CABs, periodical trainings and presence of necessary professional experience.

Taking into account that dismissed assessors remain in the Register of accreditation personnel, their dismissal doesn’t lead to any loss of NAAU competence.

Concerning financial activity of NAAU

NAAU plans its activity itself, basing on the demand on services provided and the need for production and social development of NAAU.

Basic indicators are performed in full, particularly:

- income from product sales (goods, works, services) in 2014 was –
20 310 thousands hryvna; (comparing to 2013 increased on 16 %)

- labor remuneration fund – 7 955,9 thousands hryvna;

- amount of taxes and obligatory payments paid to the budget -  8 613,1 thousands hryvna.

The tendency of growth of basic indicators can be seen by comparing them with the similar indicators for 2012, 2013:

- income from product sales (goods, works, services) in 2012 was – 15 222,3 thousands hryvna;

- labor remuneration fund – 5 396,8 thousands hryvna;

- amount of taxes and obligatory payments paid to the budget – 6 033,1 thousands hryvna;

- income from product sales (goods, works, services) in 2013 was – 17 573,4 thousands hryvna; (comparing to 2012 increased on 16 %);

- labor remuneration fund – 6 340,5 thousands hryvna;

- amount of taxes and obligatory payments paid to the budget -  7 270,7 thousands hryvna.

Concerning the debt for external staff

According to the Contracting Agreement on performance of accreditation/monitoring activities through re-accreditation (preparation for assessment) (hereinafter – Agreement), NAAU as a Customer authorizes a citizen – Contractor who takes a responsibility to perform works on accreditation of a Conformity assessment body.

According to clause 4, the cost of work and order of payments of performed works according to this Agreement the Customer pays the Contractor the amount defined by the Calculation.

By the sub-clause 4.2, it is provided the payment for works exactly according to the Agreement.

Moreover, such legal relationships are governed by the Civil Code of Ukraine, the article No 837 of which provides that one party take a responsibility to perform at its own risk the appropriate work by the assignment of other party (customer), and a customer takes a responsibility to take and pay for the performed work.

The first part of the article 843 «Cost of work» provides that the cost of work or ways of its defining are determined in the Contracting Agreement. The cost of work in Contracting Agreement includes reimbursement of expenses of contractor and payment for work performed by him.

The article 844 of the Civil Code of Ukraine provides that the cost in the Contracting Agreement can be determined in the Calculation.

At the same time the article № 854 «The order of payment for work» provides that if the Contracting Agreement doesn’t provide the preliminary payment for performed work or its separate stages, a Customer is obliged to pay the Contractor the agreed price after the final completion of work on the condition that the work is done properly and in the agreed terms or, by the agreement of the Customer, – ahead of schedule.

Taking into consideration all above mentioned provisions of the Civil Code of Ukraine and Agreements on conducting accreditation/monitoring through re-assessment concluded according to it, it is needed to note that Contractor according to the Agreement receives payment for his work, and the cost of work is determined in the Calculation which is an integral part of the Agreement.

Furthermore, according to the cl. 4.2. of the Agreement, payment is transferred to the bank account of a Contractor after signing by Parties the Act of executed works.

Also, in accordance with the cl. 7.1. the Agreement comes into force starting from the date of its signing by Parties and acts till the end of current year or till the full execution by Parties their responsibilities according to the Agreement. As for the financial responsibilities, the Agreement acts till full payment is made between the Parties.

Concerning the internal audit of NAAU activity and prices of accreditation works

According to the Decree of the Ministry of economic development and trade of Ukraine dated 09.09.2014 №1080 (Annex 3) an audit team of the Ministry of economic development and trade conducted the audit of effectiveness, audit of compliance and financial audit of the National Accreditation Agency of Ukraine on the topic «Assessment of the enterprise activity concerning internal control, level of performance and achieving goals, legality and reliability of financial reporting and budget reporting, accuracy of accounting, compliance with legislation acts, plans, procedures on preservation of assets and state property management».

Particularly, the program of the internal audit of NAAU activity was approved  by the above mentioned Decree of the Ministry of economic development and trade,. According to provisions of this program in the cl. 4 it is noted that the object of the audit is NAAU activity concerning effectiveness of internal control system functioning, performance and achieving goals, legality and reliability of financial reporting, accounting, compliance with legislation acts, plans, procedures on preservation of assets and state property management. Clause 5 provides that internal audit cover the period from January 2013 till September 2014.

On 19th of November, 2014 the audit report on the results of internal audit of the activity of the National Accreditation Agency of Ukraine was prepared.

In the summary of the report it is stated that the audit team of the Ministry of economic development and trade of Ukraine conducted the audit of effectiveness, audit of compliance and financial audit of the National Accreditation Agency of Ukraine in the part of assessment of the enterprise activity concerning internal control, level of performance and achieving goals, legality and reliability of financial reporting and budget reporting, accuracy of accounting, compliance with legislation acts, plans, procedures on preservation of assets and state property management.

The audit was conducted by the method of studying and analysis of documents on-site.

During the planning of the audit the following risk spheres were taken into account:

- system of internal control;

- NAAU decrees and their compliance with the requirements of the current legislation;

- reliability of financial reporting and accuracy of accounting;

- reasonability of manning table;

- legality and reliability of labor costs;

- costs on travel, including abroad;

- increase and decrease in assets;

- fulfillment of terms of the contract by a Chairman, namely approving agreements with the cost more than 300,0 thousands hryvna by the Ministry of economic development and trade of Ukraine;

- legality of concluding agreements with business entities and completeness of their implementation;

- reasonability of costs of conducting the Technical Committee and Accreditation Council;

- record keeping at the enterprise.

Audit conclusion on the results of the internal audit was conditionally-positive.

In the summary it was also stated that NAAU conducted its activity in accordance with the current legislation and Provision on NAAU. During the audit there were no concerns identified regarding the implementation by NAAU its functional tasks determined by the Provision.

Accounting policy of NAAU is determined in accordance with the requirements of the Law of Ukraine НААУ «On accounting and financial reporting in Ukraine» and other normative and legal acts which regulate the organization of accounting.

NAAU ensures implementation of financial plans in the part of receiving income, but during 2014 NAAU incomes are decreasing due to the absence of the income from such regions as AR Crimea, Donetsk and Lugansk regions, wich made up almost 30 percent of total business income.

Calculation of the cost of one man-day of accreditation works needs to be re-considered and brought into compliance with the real expenses of NAAU, as well as economical justification of all elements of expenses on the basis of the conducted economic analysis».

Proceeding from the audit report, NAAU needs to review the calculation of the cost of one man-day of accreditation works, and through increasing to bring it into compliance with the real expenses of NAAU.

However, in the decision of Antimonopoly Committee of Ukraine dated
03.06.2014 №319-р «On closure of case proceeding» it was stated that the Antimonopoly Committee doesn’t have any information which would prove that NAAU, establishing prices for CABs’ accreditation with the subsequent control over the compliance with the requirements of accreditation that could not be set for the conditions of existence of significant competition in the market, caused damage to individuals and society.

Concerning international activity of NAAU

According to the Agreement on association from 2009 NAAU is an associate member of the European cooperation for accreditation (EA).

European cooperation for accreditation is a body which is in compliance with the Regulation (EU) №765/2008 dated 09.07.2008 coordinates the system of expert assessment between national accreditation bodies of countries – members of the European Union and other countries of Europe.

Confirmation of NAAU activities’ compliance with the established requirements is conducted regularly by EA assessment team.

Furthermore, NAAU in 2009 joined to EА MLA in the scope of personnel certification according to the standard ISO/IEC 17024 «Conformity assessment. General requirements for bodies certifying personnel».

In 2012 NAAU enlarged its recognition within the frame of EА MLA in the following scopes of accreditation:

- calibration and testing laboratories on compliance with the standard ISO/IEC 17025 «General requirements for competence of testing and calibration laboratories»;

- management systems certification bodies on compliance with the standard ISO/IEC 17021 «Conformity assessment – requirements for bodies providing audit and certification of management systems».

In October, on the 32nd meeting of the EA Multilateral Agreement Council, NAAU obtained recognition in the scope of accreditation of inspection bodies on complience with the standard ISO/IEC 17020.

Furthermore, it was taken a positive decision on recognition of NAAU in the scope of accreditation of products certification bodies on compliance with the standards EN 45011/ISO/IEC 17065 with special conditions – conducting of surveillance for all products certification bodies and analysis of NAAU work with CABs located in the area of performing antiterrorist operation in Donetsk and Lugansk regions, as well as AR Crimea.

In October, 2014 on the 18th meeting of the General Assembly of the International Laboratory Accreditation Cooperation (ILAC) and on the 14th Joint Meeting of the General Assembly of ILAC and International Accreditation Forum (IAF) the Mutual Recognition Agreement (MRA) between ILAC and NAAU was signed, and NAAU became a full member of ILAC and signatory of ILAC MRA in the scopes of testing and calibration on compliance with the standard ISO/IEC 17025 (Annex 4).

Also it was preliminary agreed that NAAU can obtain a status of the signatory of ILAC MRA in the scope of inspection on compliance with the standard ISO/IEC 17020 «General criteria for the operation of various types of bodies performing inspection» and  obtain a status of the signatory of IAF Multilateral Agreement (IAF MLA) in the scope of management systems certification on compliance with the standard ISO/IEC 17021 «Requirements for bodies providing audit and certification of management systems» till the end of 2014 provided sending of applications on NAAU joining to ILAC MRA and IAF MLA, and conducting of the relevant evaluation procedure.

NAAU as a national accreditation body of Ukraine in its activity is guided by the requirements of ДСТУ ISO/IEC 17011:2005 «General requirements for accreditation bodies accrediting conformity assessment bodies» (hereinafter – ISO/IEC 17011).

Confirmation of compliance of NAAU activity with the eatablished requirements is carried out on regular basis by the specialists of EA.

From 12.05.2014 till 16.05.2014 EA evaluation team conducted the first part of NAAU evaluation with the aim to confirm its recognition in the following scopes:

- personnel certification bodies on compliance with the standard ISO/IEC 17024;

- calibration and testing laboratories on compliance with the standard ISO/IEC 17025;

- management systems certification bodies on compliance with the standard ISO/IEC 17021;

and obtaining recognition in the scope of accreditation of:

- inspection bodies on compliance with the standard ISO/IEC 17020 «General criteria for the operation of various types of bodies performing inspection»;

- products certification bodies on compliance with the standards EN 45011/ISO «General requirements for bodies operating product certification systems» / IEC 17065 «Conformity assessment – requirements for bodies certifying products, processes and services».

During assessment the EA evaluation team analyzed and processed the following documents of NAAU:

Management Manual;

procedures, policies and instructions that are the document of management system;

organizational structure of NAAU and the national accreditation system;

minutes of Accreditation Council Meetings;

results of the analysis of potential conflict of interest connected with activity of NAAU and bodies related to it;

job descriptions of NAAU personnel and files of NAAU employees;

documents that confirm the financial stability of NAAU – conclusions on the results of financial audits of NAAU reference on the availability of deposits (as of 01.01.2014);

records related to the functioning of corrective and preventive actions in NAAU;

report on the internal audit in 2013 (planning, execution and reporting);

minutes of the last management review (January, 2014) of the effectiveness of the internal management system functioning;

files with complaints: composition of a commission, examples of files’ consideration according to the established procedures;

files of accreditation personnel (personnel of NAAU and external experts),

reports on monitoring of accreditation personnel;

minutes of meetings of the Commission on attestation of accreditation personnel;

files on accreditation with the aim to analyze the real functioning of the process in accordance with the established procedures;

information located on the NAAU web-site, including English version of the web-site;

files with appeals: composition of a commission, examples of appeals’ consideration according to the established procedures;

records performed by NAAU assessors during on-site assessments;

General Agreement between NAAU and a  CAB.

Objects of evaluation in accordance with the requirements of the standard ISO/IEC 17011 «Conformity assessment – requirements for accreditation bodies accrediting conformity assessment bodies» were the following:

the structure of the national accreditation body (including the issue of independence, impartiality, financial stability and confidentiality);

general management (management system including the control of documents and records, competence of a person responsible for quality, inernal audit, corrective and preventive actions for nonconformities and potential nonconformities, management review, complaints etc.);

human resources (availability of sufficient number and competence of accreditation personnel, regular performance of monitoring, keeping files of accreditation personnel) both internal staff and external personnel of NAAU;

accreditation processes (initial, re-accreditation, planned and unplanned assessments, works on enlargement, reduction of accreditation scopes etc.), including all stages according to the chapter 7 of the above mentioned standard;

responsibilities of accredited conformity assessment bodies and NAAU.

Based on the results of NAAU evaluation, EA evaluation team made conclusions according to the established format (Annex 6).

In conclusions it was noted particularly that NAAU works strictly regulated management environment and it can lead to the danger of providing too much importance to formalities.

Furthermore, basing on the results of the first stage of EA evaluation of NAAU, a letter from the EA Chair, Thomas Facklam, was received by the Ministry of Ecoomic Development and Trade of Ukraine, regarding evaluation of NAAU activity in which the fact of meeting by NAAU the requirements of the Regulation (EU) 765/2008, standard ISO/IEC 17011 and obligatory documents of EA was confirmed (Annex 7).

Concerning preparation for EA evaluation of NAAU

Preparation for the EA evaluation of NAAU that will be conducted in the end of May, 2015 is performed according to the Plan of preparation to the EA evaluation of NAAU, approved by NAAU Decree dated 06 квітня 2015 №88.

As of 27.04.2015, out of 40 items of objectives and tasks provided by the above mentioned Plan:

- 27 items are already performed,

- 13 items are on the stage of performing.

Having listened and discussed the information of administration, the general meeting made decisions regarding the following issues (Annex 8):

  1. Fulfillment by administration the terms of collective agreement.

Decided: administration fulfills the terms of collective agreement in full.

  1. Amending the collective agreement for 2015-2017.

Decided: to approve amendments to collective agreement.

  1. Transition to service salary project to another bank.

Decided: to take note of the information; for interested parties – to submit applications to the Sector for accounting, planning and reporting till 30.04.2015.

  1. State of preparation for conducting the EA evaluation of NAAU. Decided: to take note of the information regarding appropriate preparation to EA peer evaluation of NAAU.
  2. Consideration of appeal of some NAAU employees.

Decided: For authorized representative of NAAU collective – to appeal to the President of Ukraine, Cabinet of Ministers of Ukraine, Ministry of Economic development and Trade of Ukraine with clarification regarding the current situation in NAAU.

Taking into account discussion of all items of the Agenda of the General meeting of labor collective, and having listened to the information of reporters as of 27.04.2015:

- the National Accreditation Agency of Ukraine acts in accordance with the current legislation and international documents, and by its activity doesn’t violate norms of current legislation;

- NAAU fulfills in full the tasks laying on it by the Law of Ukraine  «On accreditation of conformity assessment bodies» and the Provision on the National Accreditation Agency of Ukraine, approved by the Decree of the Ministry of Economic development and Trade of Ukraine  dated 05.11.2013 № 1305;

- NAAU administration fulfills in full the terms of the Collective agreement in relation to employees;

- there are no claims of labor collective to NAAU administration;

- preparation for of EA peer evaluation of NAAU is conducting on the sufficient level, according to the approved plan;

- reduction of price for accreditation activities will make impossible the participate of NAAU in the international, European and regional organizations for accreditation, including the payment of membership fees to these organizations, as well as reduction of salaries of NAAU employees, and will lead to financial instability of the organization;

- there are no claims and concerns regarding the NAAU work from the side of accredited conformity assessment bodies;

- there is no disciplinary or criminal proceedings and court cases from the executive power bodies, law enforcement and judicial authorities regarding the NAAU activities.

In accordance to the above mentioned, the collective and administration of NAAU are ready to the comprehensive and independent audit of the financial activity of NAAU, within the framework of the current legislation, after performance of the EA evaluation of NAAU activity planned for the end of May.
